This is an agreement between you and Astar Tutors (with its affiliates, "Astar" or "we") regarding the Astar Coins program (the "Program"). Before purchasing or redeeming any Astar Coins or otherwise using the Program, please read these Terms and Conditions and all rules and policies related to the Program (including any rules or provisions on any product detail page or any help or informational page relating to the Program) (collectively, the "Agreement"). If you purchase or redeem any Astar Coins or otherwise use the Program, you will be bound by the Agreement.

1. Astar Coins

The Program allows customers to purchase Astar Coins ("Coins") and to redeem those Coins when applying for tuition assignment listings ("Assignments") on the Astar Tutors web app or Telegram platform (collectively, the "Platform"). The Program includes two types of Coins: Coins you purchase from us or receive as a gift from another customer ("Purchased Coins") and Coins we give you for promotional purposes ("Promotional Coins"). Each application costs 100 Coins when applying for assignments through the Platform.

2. Use of Coins

2.1 Redeeming Coins

Coins may be redeemed only for applications to tuition assignments. The number of coins required to apply for Assignments may change at any time without notice. We will release information regarding any changes via the Platform.

2.2 Purchasing Coins

Purchases of Coins will be charged to the debit or credit card of your choice via the Stripe payment method. All purchases of Coins are final. If you believe any purchased Coins were not properly credited to your account, please contact Astar customer service for assistance. If we offer discounts on the purchase of Coins, we may modify or discontinue those discounts at any time without notice to you.

2.3 Refunds

We will only consider refunding Coins in a situation where the listed assignment is edited by the agent, parent, or student after it is posted on the Platform in a manner that would exclude tutors who have already applied for the assignment from qualifying from the Assignment. If this situation applies to you, it is your responsibility to apply for a refund via the Request for Refund form for consideration. Refund requests will only be considered if they are submitted within seven (7) calendar days from the date the offending edit was made. Any tutor who does not apply for a refund within this window has forfeited the right to do so and will not qualify for a refund. Approval of refund requests is at the sole discretion of Astar and decisions are final. Any successful refund will be in Coins and there will be strictly no cash refunds. Apart from this, we do not accept returns of Coins except where required by law.

2.4 Expiration Dates; Application of Coins

Astar Coins do not expire. Promotional Coins expire one year after the later of the date we give them to you or the date you last purchased or redeemed Coins. When you make a purchase with Coins, any Promotional Coins you have will be applied first, followed by your Purchased Coins.

2.5 Restrictions

Coins cannot be resold, transferred for value or redeemed for cash, except to the extent required by law. Coins in one Astar account may not be transferred to another Astar account. We may limit the number of Coins you can purchase within certain periods of time, or implement other restrictions on the receipt or use of Coins.

3. General

3.1 Changes

We may change, suspend or discontinue the Program, or any part of it, at any time without notice.

3.2 Termination; Fraud

Your rights under the Agreement and to use the Program will automatically terminate without notice if you fail to comply with any of the terms of this Agreement. We may also terminate your right to use the Program at any time, including if we determine your use violates any term of the Agreement or involves any fraud or misuse of the Program. In case of such termination, you must cease all use of the Program, and we may immediately revoke your access to the Program without notice to you. If we determine you fraudulently obtain Coins or use any fraudulently-obtained Coins, we may revoke those Coins and charge your credit card or other payment instrument for any products purchased using those Coins. Our failure to insist upon or enforce your strict compliance with the Agreement will not constitute a waiver of any of our rights.

3.3 Amendments

We reserve the right to amend the Program and Agreement at our sole discretion at any time without notice. The updated terms will be posted here. It is your responsibility to scan the Agreement periodically for modifications. Your continued use of the Program after any amendment evidences your agreement to be bound by it.

3.5 Disputes/Binding Arbitration

If the parties are not able to overcome any dispute between them arising out of or concerning the program’s Agreement, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such conflict shall be overcame only by final and binding arbitration or a similar arbitration service selected by the parties, in Singapore. The arbitrator’s award is final, and judgment is to be entered upon it in any court having jurisdiction. If any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall is entitled to recover its costs and reasonable fees. User agrees to arbitrate all disputes and claims in regards to these Terms or any conflicts arising as a result of these Terms, whether directly or indirectly, including tort claims that are a result of these Terms and Conditions.

3.6 Limitation of Liability

In no event will our total liability to you for all damages arising out of or related to the Program exceed the amount you paid for any Coins that you have not redeemed. This limitation will apply to you even if the remedies fail of their essential purpose. We are not responsible for any Coins purchased or used through your account without your permission.
